1.2 Service Agreement

A separate service agreement or contract will be executed for each project, outlining specific terms, deliverables, timelines, payment schedules, and other project-specific details.

2. Use of Website

2.1 Permitted Use

You may use our website for the following purposes:

• Browsing our portfolio and services
• Requesting quotes or consultations
• Contacting us for inquiries
• Reading blog articles and design tips
• Downloading publicly available resources

2.2 Prohibited Activities

You agree NOT to:

Design concepts, 3D renders, drawings, and plans created by Sharma Interiors remain our intellectual property until full payment is received. Upon full payment, ownership of the design for the specific project is transferred to the client for their personal use only.

3.3 Portfolio Usage

We reserve the right to photograph completed projects and use images for portfolio, marketing, and promotional purposes unless explicitly restricted by client agreement.

4. Project Terms

4.1 Quotations

All quotations are valid for 30 days from the date of issue unless otherwise specified. Prices are subject to change based on material costs, project modifications, or market conditions.

4.2 Payment Terms

Payment schedules will be outlined in the project contract. Standard payment terms include:

• 25% advance on project commencement
• 35% on material procurement
• 25% on 50% project completion
• 15% on final handover

Delayed payments may result in project suspension or cancellation.

4.3 Project Changes

Changes requested by the client after design approval may incur additional costs and affect project timelines. All change requests must be documented and approved in writing.

4.4 Project Delays

We are not responsible for delays caused by:

• Client-requested changes or approvals
• Site access restrictions
• Material unavailability or supply chain issues
• Weather conditions affecting outdoor work
• Force majeure events
• Regulatory or permit delays

4.5 Warranty

We provide warranty coverage as follows:

• Workmanship: 1-2 years from project completion
• Modular products: As per manufacturer warranty (5-10 years)
• Hardware and fittings: As per manufacturer warranty

Warranty does not cover damage due to misuse, negligence, accidents, or normal wear and tear.

5. Client Responsibilities

As a client, you are responsible for:

• Providing accurate project information and requirements
• Timely approvals and decision-making
• Ensuring site access and readiness
• Obtaining necessary permits and approvals (unless covered in turnkey agreement)
• Protecting installed materials and work in progress
• Making payments as per the agreed schedule
• Clear communication of concerns or issues

6. Cancellation and Refunds

6.1 Client Cancellation

If you cancel a project after signing the contract:

• Before work begins: 50% of advance payment refunded
• After work begins: Charges for completed work + material costs will be deducted
• After 50% completion: No refunds

6.2 Our Cancellation

We reserve the right to cancel or suspend projects in case of:

• Non-payment by client
• Client breach of agreement terms
• Impossibility of project execution
• Safety concerns

7. Limitation of Liability

To the maximum extent permitted by law, Sharma Interiors shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Damages exceeding the total project value
• Issues arising from client-supplied materials or products
• Pre-existing structural defects in the property
• Damage caused by third-party vendors or contractors

8. Dispute Resolution

8.1 Amicable Resolution

In the event of any dispute, both parties agree to first attempt to resolve the matter through good-faith negotiations.

8.2 Mediation and Arbitration

If negotiations fail, disputes shall be resolved through mediation or arbitration in Pune, Maharashtra, India, in accordance with Indian Arbitration and Conciliation Act, 1996.

8.3 Jurisdiction

These Terms shall be governed by the laws of India. Courts in Pune, Maharashtra shall have exclusive jurisdiction over any legal proceedings.

9. Privacy and Data Protection
